We consider appeals against a decision made by the Secretary of State to restrict or bar an individual from working with children or vulnerable adults and decisions to cancel, vary or refuse registration of certain health, childcare and social care provision.
You can appeal to us if you:
-
Have received a decision you do not agree with about your registration as:
- A child minder or other child care provider
- A care home provider or manager
- A children’s home provider or manager
- An independent healthcare provider or manager
- The provider of an agency that delivers personal or nursing care in someone’s home
- The provider of an agency that delivers fostering or adoption services
- A social worker or social care worker.
- Have been barred from teaching or otherwise working with children by the Secretary of State for Education and Skills * Please see note
- Have been barred from working with vulnerable adults by the Secretary of State for Health*
* Please note that the arrangements for barring an individual from working with children or vulnerable adults has changed . A new body – the Independent Safeguarding Authority (ISA) has taken over such decisions from the Secretary of State, although there are still a few decisions that the Secretary of State has to finalise.
All appeals against a decision of the ISA will be considered by the Administrative Appeals Chamber of the Upper Tribunal, not the FTT – Care Standards. You can download the appropriate appeal application form and guidance from this website see Forms and Guidance page.
The First–tier Tribunal (Mental Health) hears applications and references for people detained under the Mental Health Act 1983 (as amended by the Mental Health Act 2007). Our Tribunal judiciary and members are appointed by the Lord Chancellor. Our jurisdiction covers the whole of England. There are two Regional Tribunal Judges, currently based in London and Preston. There is a separate Mental Health Tribunal for Wales, which is administered and based in Cardiff and a separate Mental Health Review Tribunal for Scotland.

From 3rd November the Special Educational Needs and Disability Tribunal ceased to exist as a stand-alone body and became part of a new two-tier Tribunal structure; the First-tier Tribunal and the Upper Tribunal. The two new Tribunals consist of chambers that group together jurisdictions dealing with similar work or requiring similar skills.
The existing judges and non-legal members of the Special Educational Needs and Disability Tribunal all transferred into the new two-tier system and continue their vital work in much the same way as they did before. Special Educational Needs and Disability now sits in the Health, Education and Social Care (HESC) Chamber of the First-Tier Tribunal. Appeals against the panel's decisions now go to the Upper Tribunal instead of to the High Court.
Parents whose children have special educational needs can appeal to the First-tier Tribunal (Special Educational Needs and Disability) against decisions made by Local Education Authorities in England about their children's education.

Appeals registered under the old Rules
Any case that was registered before the 3rd November will proceed through the First-tier Tribunal process under the Regulations that applied to the Special Educational Needs and Disability Tribunal (SEND). These appeals can be easily identified as they will have been given an Appeal Reference Number lower than 08-03261.
The only exception will be for a small number of cases that were pre-registered before the 3rd November with a letter requesting further information being issued to the applicant. In these cases, if all of the required information was received on or after 3rd November, the appeal will proceed under the relevant First-tier Tribunal Rules.
The Rules for the First-tier Tribunal (Special Educational Needs and Disability) will apply to any application to review or appeal decisions after a final tribunal decision has been made if the decision was issued after 3rd November irrespective of when the hearing took place. This means that these provisions will apply to any case that is proceeding under the old regulations.
Anyone wishing to make an appeal against a decision made by the Tribunal (either SEND or First-Tier) on or after November 3rd will need to follow the relevant First-tier Tribunal Rules and appeal to the Upper Tribunal.

I am announcing today the launch of Her Majesty's Courts and Tribunals Service as an executive agency of the Ministry of Justice. It brings together Her Majesty's Courts Service and the Tribunals Service into one integrated agency providing support to the judiciary in the administration of justice in courts and tribunals.
The agency is responsible for the administration of the criminal, civil and family courts and tribunals in England and Wales and non-devolved tribunals in Scotland and Northern Ireland. It provides for a fair, efficient and effective justice system delivered by an independent judiciary.
I believe that operating as a single organisation will provide the platform to improve accessibility, drive up quality and provide a better environment for service users. Integration will enable those who need to use the agency's services to do so in a simple and straightforward way, using a single point of access. Bringing corporate functions together will remove duplication in management functions and enable efficiencies which do not impact on front line services. Integration will also enable more efficient use of the combined estate, using facilities flexibly across jurisdictions.
Her Majesty's Courts and Tribunals Service uniquely operates on the basis of a partnership between the Lord Chancellor, the Lord Chief Justice and the Senior President of Tribunals as set out in Her Majesty's Courts and Tribunals Framework Document.
