In times of recession it is not only those who are on benefits and looking to get back to work that may be affected. People also loose their jobs. It can be difficult to get new employment if you have HIV and it impacts on your day-to-day living. You may also have disclosed your status to your previous employer as you felt comfortable in doing so and in applying for a new job the topic of disclosure may be one you face again.

Companies operate differently. You are entitled to a minimum redundancy payment but some companies may pay more.
If you feel you have been made redundant and this is related to your HIV status you should seek legal advice on how to proceed.
Speaking at the Conservative Party Conference, on 3 October 2011, Chancellor George Osborne announced that, from April 2012, employees will need to be employed for two years before they can make a claim for unfair dismissal. Currently an employee can claim for unfair dismissal after being employed for only a year.
Also, from April 2013, the Government will introduce fees for employment tribunals. There is currently no charge for an applicant who wants to make an employment tribunal claim.


When calculating Statutory Redundancy Payments note that if you are made redundant from October 2009 the weekly earning ceiling amount will increase from £350 at present to £380.
The TUC had called for this ceiling to raise to £500 inline with average earnings.
