INTRODUCTION

1 This memo gives guidance on the ESA (Work-Related Activity) Regulations 2011¹ (“ESA (WRA) Regs”), which come into force on 1.6.11.

2 The regulations

1. introduce a requirement for some ESA claimants who are already required to take part in WFIs to undertake work-related activity (“WRA”)¹ (see paragraphs 3– 21)

2. amend the existing ESA WFI provisions² (see paragraphs 22 – 30)

3. revoke the provisions about the requirement to take part in a WFHRA³ (see paragraph 31)

4. allow payments for travel and other expenses in relation to a requirement to undertake WRA to be disregarded as income and capital⁴ (see paragraphs 32 –33)

5. amend the definition of a failure determination (see DMG 53050) for the
purposes of revision and supersession5 (see paragraph 34).
